How Agents Decide Who Goes to the US

(RepublicanReport.org) – US Customs and Border Patrol (CBP) has been overrun with migrants in the past few years, with millions illegally crossing the Southern border. In Fiscal Year 2020, there were only 458,088 encounters along the southwest land border. However, that number increased to 1.7 million in 2021 and over 2.3 million in 2022. Between October 2022 and April 2023, there were over 1.4 million encounters. CBP cannot house this enormous number of migrants, and many are released into the country. The Daily Caller just got an exclusive look at the checklist agents use to decide if someone can walk free into the US.

On Tuesday, May 16, the Daily Caller published a checklist from December 2022 detailing the necessary steps for CBP sectors to use a “Safe Community Release.” First, Immigration and Customs Enforcement (ICE), nongovernmental organizations (NGOs), and CBP facilities must be at capacity. Next, CBP agents must have fully processed the illegal migrants, including getting a release disposition.

Once those criteria are met, the CBP sector has to submit the checklist to CBP headquarters at least one hour before the release with information about the detention centers at capacity, the total number, location, and time of the releases, as well as a breakdown of their nationality and demographics. Lastly, the sector needs to give heads-up to headquarters if there is media attention or other “pertinent information.”

National Border Patrol Council President Brandon Judd spoke with the Daily Caller News Foundation and said that while the checklist is the standard set by the government, it’s possible it “falls through the cracks because of how busy we are.”

While President Joe Biden acknowledged that the southern border will still “be chaotic for a while” after the end of Title 42, according to the Associated Press, he has repeatedly said it is not a crisis like most people have made it out to be.
